Real Estate

The firm represents home buyers and home sellers in connection with the sale of real estate. Although many people buy and sell real estate without using an attorney this can lead to costly financial problems. What most people are unaware of is that the legal cost to fix a problem is often something they cannot afford whereas the cost to avoid the problem in the first place is minimal. Essentially by using an experienced attorney to buy or sell real estate you spend a little money to save a lot of money.

In addition to traditional home sales where a Realtor is involved, the firm represents consumers in connection with Land Contracts and also in for sale by owner transactions. The firm can handle the entire home sale transaction from contract preparation and negotiation through the actual closing of title.

The firm regularly prepares deed transfers (quit claim deed or warranty deed) for clients in connection with funding Revocable Living Trusts and other types of Trusts. This is necessary to avoid Probate. Another special type of deed that is often prepared in connection with an estate plan is a “Lady Bird” deed. This type of deed avoids Probate and is an asset protection planning tool to avoid the Medicaid Probate Estate Recovery process. The Lady Bird deed also provides income tax savings and often the elimination of capital gains when the ultimate takers of the real estate sell it.

In connection with deed transfers in the estate planning process the firm will also prepare and file property transfer affidavits for clients. This is necessary to avoid an uncapping of the taxable value of someone’s home and a resulting increase in real estate taxes.

The firm also can assist in Lease preparation, review and negotiation for either Landlords or Tenants. This would include both residential leases for homes and apartments and commercial leases for office or retail space. The firm can also assist Landlords in residential and commercial eviction proceedings.
